Every journey booked through me is powered by Travel Counsellors and operates in accordance with the Travel Counsellors’ Terms & Conditions

These Terms & Conditions set out the basis on which Kate Bailey Travel (“KBT”, “we”, “us”, “our”) arranges and/or organises your travel services. “You” and “your” refer to all persons named on a booking (including anyone later added or substituted).

Who we are
Kate Bailey Travel operates as an independent franchise of Travel Counsellors Limited (company no. 2133414), registered office: Venus Building, No. 1 Old Park Lane, Trafford City, Manchester, M41 7HA. Depending on what you book, we may act as agent for the supplier/principal of your travel services, or as organiser of a package (see below).

What you can book with us

A combination of travel services for the same trip/holiday may create a Package under the Package Travel and Linked Travel Arrangements Regulations 2018. When we organise the package, it is a KBT Package (as organiser on behalf of Travel Counsellors Limited). We may also sell Third-Party Packages organised by other travel companies.

If you book a single service only (e.g., accommodation-only or flight-only), this is a Single Component booking. For Single Components and Third-Party Packages we act as agent for the relevant supplier/principal, and their terms apply in addition to these terms.

1) Booking & Confirmation

1.1 By making a booking the lead passenger confirms that he/she: (a) has read these terms and agrees to them on behalf of the party; (b) consents to our use of personal data in line with our Privacy Notice; (c) is over 18 and all travellers meet any applicable age limits; and (d) accepts financial responsibility for all payments due.

1.2 A booking is made when: (i) you accept our quotation; (ii) you pay the required deposit or balance; and (iii) we or the supplier/principal issue a booking confirmation. Until then, no contract exists and we may decline a booking.

1.3 Please check all documents immediately and notify us straight away of errors. Changes after confirmation may incur charges.

2) Payment

2.1 The balance is due by the date shown on your confirmation/invoice. Failure to pay on time may result in cancellation and charges under section 8.

2.2 For ATOL-protected bookings, money paid to an authorised Travel Counsellors franchisee/agent is held for the benefit of the Air Travel Trust until used or refunded under ATOL rules.

2.3 For Single Components/Third-Party Packages, monies are held on behalf of the supplier/principal until remitted to them.

3) Special Requests
We will pass on requests (dietary, room preferences, etc.) but cannot guarantee them and accept no liability if unmet.

4) Insurance
Adequate travel insurance is a condition of booking. Policies should cover medical needs, cancellations, repatriation, and pre-existing conditions.

5) Accommodation Ratings & Standards
Ratings are supplier-provided and not guaranteed.

6) Disabled Travellers & Medical Conditions
Disclose any medical or mobility needs before confirming your booking. We may require a doctor’s certificate. If needs cannot be met, we may decline or cancel the booking.

7) Pricing & Service Charges

7.1 Prices may change before booking. For KBT Packages, post-confirmation increases may occur due to: (i) transport/fuel costs; (ii) taxes/fees; (iii) exchange rates.

7.2 If the increase exceeds 8%, you may accept, switch packages, or cancel for a refund. You must respond within 7 days.

7.3 Decreases will be refunded less a £10 admin fee. No changes occur within 20 days of departure.

8) Changes, Cancellations & Transfers by You

8.1 All requests must be made by the lead passenger in writing.

8.2 Amendments: Subject to availability. Charges include supplier fees plus £50 per person per change.

KBT Packages – Cancellation Charges:

Within 14 days 100% of total invoice

Insurance premiums and amendment fees are non-refundable.

8.4 Unavoidable & Extraordinary Circumstances: If the FCDO advises against travel and your holiday is significantly affected, you may cancel for a full refund.

8.5 Transfers: You may transfer your package to another person if: conditions are met; notice is given 7+ days before departure; all sums and a £50 per person fee are paid; and the transferee accepts these terms.

9) Changes & Cancellations by Us or Suppliers

9.1 For Single Components/Third-Party Packages, we pass on supplier notifications but liability rests with the supplier/principal.

9.2 KBT Packages — Insignificant changes: examples include flight time changes <12 hours, aircraft type, equivalent accommodation.

9.2 KBT Packages — Significant changes: include major itinerary changes, significant accommodation changes, or departure airport changes over 150 miles.

9.3 We aim not to cancel within 60 days except for force majeure or non-payment.

If we significantly change or cancel a KBT Package, you may accept, refund, switch to comparable arrangements, or accept lower-standard options with a reduction.

9.5 Compensation (KBT Packages):

No compensation applies where changes result from Force Majeure or your failure to pay.

10) Our Responsibilities

KBT Packages: We are responsible for proper performance of included services. Remedies include price reductions or compensation, except where failure results from: (a) your acts/omissions; (b) an unforeseeable third party; or (c) force majeure.

Limits apply under international conventions. You must follow the complaints procedure and assign rights to us/insurers if compensation is paid.

Single Components/Third-Party Packages: Our liability is limited to reasonable skill and care as booking agent. Maximum liability is twice our commission, except for death/personal injury due to our negligence.

11) Force Majeure
Events beyond our or suppliers’ control relieve us of liability, including terrorism, war, epidemics, natural disasters, extreme weather, strikes, and government actions. Brexit-related changes may also apply.

12) Prompt Assistance
If you encounter difficulty during a KBT Package, we will assist (e.g., healthcare, communication support, alternative travel). Costs may apply if the difficulty is caused by you. Duty office: +44 (0)161 608 1052.

13) Behaviour
We may terminate arrangements without refund if your behaviour causes danger, distress, damage, or disruption.

14) Passports, Visas & Health
You are responsible for meeting all entry, health, and documentation requirements. UK travel advice: https://www.gov.uk/travelaware

15) Law & Jurisdiction
English law applies. Courts of England & Wales have exclusive jurisdiction unless you live in Scotland or Northern Ireland.

16) Complaints
Raise issues immediately with the supplier and contact us if unresolved. After travel, complaints must be made within 14 days. Alternative dispute resolution is available via ODR Platform.

18) Financial Protection (ATOL & Trust)

ATOL-protected bookings fall under ATOL 6751. You will receive an ATOL Certificate detailing protections. Non-flight KBT Packages are protected by the Travel Counsellors Trust Fund.

19) Delays, Missed Transport & Travel Information
Airline delay and cancellation rights apply under relevant law. We are not liable for delays caused by Force Majeure.

20) Out-of-Date-Range Flights
Where flights are not on sale at time of booking, deposits may be taken on expected availability. If pricing/timing changes, you have 7 days to accept or cancel for a refund.

Key Rights (Package Travel Regulations 2018)
KBT Packages provide legal protections including refunds, replacement services, assistance, compensation in some cases, and insolvency protection.

Definition of a KBT Package
A package exists when at least two qualifying travel services are booked together under one contract or inclusive price.
